LockedDiehard Platinum Warranty

I have a 1yr old Diehard Platinum batt that wont hold a charge above 12.4v. Took it for testing yesterday, truck charging system is fine, they topped of the batt and I went home. This morning its back to 12.39v, I want to replace the batt outright they want to test it again and trickle charge it.

Can anybody point me to the actual Platinum warranty so I can see what my rights are in this situation? I don't have time to go back and forth to my local Sears checking and re checking a batt I know is bad. I just want a good, fully charged replacement.

What do you consider a full charge? Some batteries only come to a certain voltage. I was an an electronic technician. Rechargeable AA, "C" cells, 9 volt batteries never reach the full  voltage of throw away batteries.

Surface charge on a 12v car battery immediately after charging should be around 12.8v, but will settle to 12.75 - 12.65 (full charge). 12.4v is around 70% - 75% I think. My batt shows 12.38 after sitting one night. Not ok for a 1 year old $200 AGM battery.

Sears wants to "test" this batt 2 more times before authorizing an exchange. They also suggested that I would have to pay for the test even if the batt fails... absolutely not.

I'm beginning to have serious doubts about the Sears commitment to quality an their warranties.

I bought a P-4 about two weeks ago for a 2K Vette. This made me curious so I checked the voltage this morning.

12.53 at 48 Degrees F = 12.4977 corrected meaning minus  ((80-47.7) / 10) * .01 = .0323 from the measured voltage of 12.53 for the temp. offset.

The battery manuf. date is 9/09 so it was pretty fresh.  When not in use, it is always on a Deltran Plus charger.  It was on the charger when I took to measuments.

Parasitic drain from the Vette is bad enough that I always connect the charger after I take her out.  The DELCO 7yr. battery the P-4 replaced was **** near 7 years old.
