Bottom Element Burns Up

We bought this model in Mar 2005. In Dec 2005, the bottom element wiring caught on fire. It took a few days, but Sears replaced it with a new water heater of the same model. In Dec 07 the water began to overheat and the hot water safety button was tripping and turning off the hot water heater. This stopped happening all of a sudden, but the thermostats were replaced just in case. Now, in Jan 08, the bottom element wiring caught on fire again. Called sears and they said it was no longer under warranty. Since we are fed up with this model and think it is dangerous (Sears thinks the model is fine), I did not read the warranty to the girl on the phone about parts being covered from years 1-12. We don't want to replace the bottom element because we don't want any more fires in our basement. We will be putting down hundreds of more dollars for a new hot water heater, but we will not be buying Kenmore. Sears and Kenmore just don't make things like they used to.
